LiveNationTheatres.co.uk is owned and operated by Live Nation (Venues) UK Ltd. ("our", "us" and "we") We're a company registered in England and Wales with registration number 01444368. Our registered office is 2nd Floor, Regent Arcade House, 19-25 Argyll Street, London W1F 7TS, and our VAT number is 332 644 961. These are the LiveNationTheatres.co.uk terms and conditions (the "Conditions"), which apply to the use of the LiveNationTheatres.co.uk by end users. By accessing LiveNationTheatres.co.uk, you agree to be bound by the Conditions. LiveNationTheatres.co.uk is provided for the benefit of residents of the United Kingdom, over the age of 18. If you are not a UK resident, over the age of 18 or do not agree to be bound by the Conditions, you may not use or access LiveNationTheatres.co.uk and we will have the right to restrict or prevent your access to LiveNationTheatres.co.uk. 1 YOUR OBLIGATIONS


1.1 You will not:

(a) use LiveNationTheatres.co.uk (or any part of it) for any illegal purpose and agree to use it in accordance with all relevant laws;

(b) upload or transmit through LiveNationTheatres.co.uk (i) any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or (ii) any material which is defamatory, offensive, or of an obscene or menacing character, or that may cause annoyance, inconvenience or needless anxiety;

(c) use LiveNationTheatres.co.uk in a manner which (i) may cause LiveNationTheatres.co.uk to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of LiveNationTheatres.co.uk is in any way impaired or (ii) violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality or rights of privacy); and

(d) create or publish a hypertext link to any part of LiveNationTheatres.co.uk or attempt any unauthorised access to any part or component of LiveNationTheatres.co.uk.

1.2 You agree that in the event that you have any right, claim or action against any end user of LiveNationTheatres.co.uk arising out of that end user's use of LiveNationTheatres.co.uk, then you will pursue such right, claim or action independently of and without recourse to us.


2 OUR RIGHTS


2.1 We reserve the right to:

(a) modify or withdraw, temporarily or permanently, LiveNationTheatres.co.uk (or any part of it) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of LiveNationTheatres.co.uk; and/or

(b) change these Conditions from time to time. Your continued use of LiveNationTheatres.co.uk (or any part of it) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using LiveNationTheatres.co.uk; and/or

(c) monitor any activity and content associated with LiveNationTheatres.co.uk. We may investigate any reported violation of these Conditions or complaints relating to LiveNationTheatres.co.uk and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from LiveNationTheatres.co.uk).

2.2 We will use our reasonable endeavours to maintain LiveNationTheatres.co.uk. LiveNationTheatres.co.uk is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of LiveNationTheatres.co.uk because of a failure, suspension or withdrawal of all or part of LiveNationTheatres.co.uk for any reason.

You acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content (including misrepresentative or defamatory content) of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external sites or resources.


5 ACCESSIBILITY


We take our responsibility for making accessible web content and software seriously. 6.3 Unless specified in separate terms and conditions related to a particular product or service, we make no warranty that LiveNationTheatres.co.uk or products or services offered on LiveNationTheatres.co.uk whether by us or on our behalf (including free software downloads) will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that LiveNationTheatres.co.uk or the server which makes it available or products or services offered on LiveNationTheatres.co.uk whether by us or on our behalf (including free software downloads) are free of viruses or bugs or are fully functional, accurate, or reliable. We will not be responsible or liable to you for any loss of content or material as a result of uploading to or downloading from LiveNationTheatres.co.uk.

6.4 Notwithstanding any other provision in the Conditions, nothing shall limit your rights as a consumer under English law.

6.5 You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of LiveNationTheatres.co.uk and any information provided to or taken from LiveNationTheatres.co.uk by you.

6.6 We will not be liable (i) in contract, tort (including, without limitation, negligence) or otherwise for:
(a) any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
(b) any loss of goodwill or reputation; or
(c) any special or indirect or consequential losses, howsoever arising and;
in any case whether or not such losses were within the contemplation of either of us at the date on which the event giving rise to the loss occurred.

6.7 Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees, or any liability in the tort of deceit.


7 INTELLECTUAL PROPERTY AND RIGHT TO USE


7.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content contained within LiveNationTheatres.co.uk shall remain at all times owned by us or our licensors. You are permitted to use this material only as expressly authorised by us.

7.2 You acknowledge and agree that the material and content contained within LiveNationTheatres.co.uk is made available for your personal non-commercial use only and that you may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of LiveNationTheatres.co.uk is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

7.3 Except for Personal Data, any information you submit to LiveNationTheatres.co.uk, whether by way of comment, any chat room function or otherwise, will not be treated confidentially and you acknowledge that we may use such information for any purposes subject to these Conditions.


8 GENERAL

8.1 If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

8.2 These Conditions (as amended from time to time) contain the entire agreement and understanding between us in respect of all matters which are referred to herein and supersede any prior written or oral agreement between us relating to such matters. No oral explanation or oral information given by either of us shall alter the interpretation of these Conditions. You confirm that, in agreeing to accept these Conditions, you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of these Conditions. However, nothing in these Conditions purport to exclude liability for any fraudulent statement or act.

8.3 The Conditions will be exclusively governed by and construed in accordance with the laws of England and Wales whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

1. INTRODUCTION


1.1 Protecting your privacy as a user of LiveNationTheatres.co.uk is important to us and we strive to keep all information relating to you confidential in accordance with this statement. As part of the normal operation of our services you may voluntarily provide us with information about yourself ("Personal Data"). The purpose of this Privacy Statement is to explain what Personal Data we collect about you, how that Personal Data might be used and how we protect your Personal Data and privacy.

1.2 We will be happy to answer any enquiries from you regarding this Privacy Statement, the Personal Data we hold about you or the use we make of it. If you have any queries or comments please contact us via the contact details on each venue site. If you (as a member) wish to correct, update, amend or remove any information we hold about you, you may also use the "Edit" section when you are logged in. We may charge a small fee towards the cost of administering any request you make.


2. WHAT DATA DO WE COLLECT AND HOW?


Non-members

2.1 if you are merely visiting the public areas of LiveNationTheatres.co.uk, we do not collect any Personal Data about you. However, we may automatically collect information about your visits, such as browsing patterns. Information collected in this way does not reveal your contact details or any type of Personal Data. This information is only used in aggregate form to analyse, manage and develop LiveNationTheatres.co.uk and is not linked to any individual.


Members

2.2 If you are a member of LiveNationTheatres.co.uk we will collect and hold Personal Data about you when you apply to become a member. The Personal Data collected by us will include your full name, password, e-mail address, date of birth, gender, country of residence, postcode and your mobile telephone number. From time to time you may also provide other Personal Data which we need to provide you with the service you request, such as your credit card details, other information about yourself, your preferences or your experiences.


3. HOW DO WE USE MEMBERS' PERSONAL DATA?

3.1 We will use all Personal Data for the purpose of providing you with the services you have requested in accordance with the Conditions.

3.2 From time to time, we may use your Personal Data to let you know about other services and products that we or our associated companies provide, special offers and also to provide news about our business. This will be in accordance with the preferences for LiveNation updates which you have registered with us. You may amend your preferences at any time in accordance with clause 1.2 above.


Legal requirements

3.3 We reserve the right to access and disclose Personal Data to comply with applicable laws and lawful government requests or requests by the police investigating suspected illegal activities, to operate our systems properly or to protect ourselves or other LiveNationTheatres.co.uk users. We also reserve the right to disclose Personal Data to third parties if a complaint arises concerning your use of LiveNationTheatres.co.uk, and that use is deemed by us to be inconsistent with the Conditions.


Public Forums

3.4 LiveNationTheatres.co.uk may make available chat rooms, forums, message boards, reviews and news groups. Please remember that any Personal Data that you disclose in these areas of LiveNationTheatres.co.uk becomes public information and you should exercise caution when deciding to disclose any information on them.


4. HOW DO WE PROTECT MEMBERS' PERSONAL DATA?

6.SALE OR MERGER


6.1 If LiveNationTheatre.co.uk is sold to or merges with, or if our business is sold to, merges with or enters a joint venture with another company not owned by Live Nation (Music) UK Limited, you should expect that some or all of the Personal Data collected from LiveNationTheatre.co.uk may be transferred to the buyer/surviving company. If so, we will seek to obligate the other company to use any Personal Data transferred by LiveNationTheatre.co.uk in a manner consistent with this statement, but we cannot guarantee that we will be able to impose that requirement or that the acquiring company will comply.


7. THIRD PARTIES


7.1 From time to time we may enter into a special relationship with another company that is not owned by us to provide additional features on LiveNationTheatres.co.uk. As a result of these special relationships, LiveNationTheatres.co.uk may sometimes feature co-branded micro sites or webpages, for example, a page with our name and TicketMaster's name.


7.2 You should look for a specific privacy statement on any such co-branded page. Any Personal Data that you provide when signing up on one of these co-branded pages may be shared with our third party partner in accordance with the privacy statement on that page.


8. CONSENT


8.1 By accepting the Conditions or by using the services on LiveNationTheatres.co.uk, you consent to the collection and use of your Personal Data by us for the purposes outlined above and for any other purpose which is reasonably necessary for the provision or proper administration of the LiveNationTheatres.co.uk service in accordance with the Conditions.


8.2 You agree that your Personal Data may be transferred to countries outside the European Economic Area for the purposes described above to countries which may not provide legal protection of Personal Data equivalent to the level of protection within the United Kingdom.


8.3 if you do not wish your Personal Data to be used in the manner set out in this Privacy Statement or the Conditions please do not use LiveNationTheatres.co.uk.


9. CHANGES TO OUR POLICY


9.1 This Privacy Statement is subject to change at any time. We encourage you to review the Privacy Statement regularly for any changes. We will use Personal Data in accordance with the Privacy Statement under which that Personal Data was collected.

Box Office (Sales) Terms and Conditions

In these terms and conditions:
Event means an entertainment event including, without limitation, a theatrical event to be held at the Theatre in respect of which the Management has the right to sell you tickets; Management means Live Nation (Venues) UK Limited, its representatives, servants and employees; Promoter means the person or company staging the Event if different from the Management. Theatre means [insert name and address of theatre]; you means you or anybody who in the Management's reasonable opinion is acting with your authority or permission.

1. All tickets are sold subject to these terms and conditions (copy available upon request) and incorporate and should be read in accordance with the Theatre terms, conditions and regulations, copies of which are available upon request from the Theatre.

2. Only customers holding a valid ticket will be admitted into an Event. Babes in arms (children under 2 years of age) will only be admitted into an Event without a ticket with the specific authorisation of the Management. Children (ages 2 to 15 inclusive) shall require their own ticket which shall be at full ticket price if no child concessions are available at the time of booking.

3. Removing any part of, altering or defacing the ticket may invalidate a ticket holders' ticket.

4. Upon purchase, please check tickets carefully as mistakes cannot always be rectified after purchase. Tickets are not issued on a sale or return basis and refunds will not be made on returned tickets unless provided for under these Terms and Conditions.

5. The Management will not be responsible for any ticket that is lost, stolen or destroyed. Duplicates may be issued at the Management's discretion. In the event of duplicates being issued, a reasonable administration charge may be levied.

6. All ticket discounts are subject to limited availability, and the discretion of the Management and/or Promoter. Only one discount per ticket may apply. Proof of identity and concession entitlement (for example of age, employer or student status (if relevant)) may be requested.

7. The ticket holder only has the right to a seat of a value corresponding to that stated on the ticket and the Promoter and the Management reserve the right to provide alternative seats to those specified on the ticket should the staging of the Event so reasonably require. Where only seats of a lesser value are available, the Management shall compensate affected ticket holders to a maximum of the difference between the cost of the seats.

8. Tickets are sold subject to the Promoter's and the Management's right to alter or vary the published Event programme where reasonably necessary.

9. It is your responsibility to ascertain whether an Event has been cancelled or re-scheduled and the date and time of any re-scheduled Event. Where an Event is cancelled or re-scheduled, the Management will use its reasonable endeavours to notify you using the details you provided it with at the time of booking. The Management does not guarantee that you will be informed of such cancellation before the date of the Event. It is your responsibility to inform the Management of any change to the contact address, telephone number or email address you provide it with at the time of ordering.

10. Tickets cannot be exchanged or refunded after purchase unless the performance is cancelled, rescheduled or where there is a material change to the Event. A 'material' change is a change which, in the Management's reasonable opinion, makes the Event materially different to the Event that purchasers of the ticket, taken generally, could reasonably expect. The use of understudies shall not be a material change.

11. Where an Event is cancelled, rescheduled or where there is a material change to the programme of the Event, you will be entitled to claim a refund from the Management in accordance with this clause. Where such a refund is sought due to a material change in the Event, you must bring this to the Management's attention as soon as possible upon becoming aware of such change. Where a refund is sought due to the Event being rescheduled you must bring this to the Management's attention prior to the rescheduled Event.

12. The refund for tickets equals the face value of the tickets purchased plus the relevant per ticket booking fee. In order to claim your refund, please apply in writing to the Management, enclosing your complete unused tickets within 3 months from the date of the Event. The Management will not make any refund if tickets are not received by the Management within 3 months of the date of the Event. Refunds will only be made to the person who purchased the tickets. Please note that in any event, no cash refunds will be given.

13. Tickets are personal revocable licences and shall at all times remain the property of the Management and subject to these Terms and Conditions. If a ticket is re-sold, transferred or advertised for profit or commercial gain by anyone other than the Management, Promoter, or an authorised sub-agent, it will become voidable and the ticket holder may be refused entry to, or ejected from, the Theatre without refund.

14. Tickets obtained in breach of these Terms and Conditions shall be null and void and the Management may refuse to admit such ticket holder into the Theatre. Any person seeking to use such a void ticket in order to gain or provide entry to an Event will be considered to be a trespasser and will be ejected and liable to legal action. Void tickets are non-refundable.

15. Where a performance is sold out, the Management will endeavour to resell any unwanted tickets at the ticket holder's request. Such tickets will be resold at face value and the original ticket purchaser or holder (as appropriate) will be reimbursed the face value of the ticket less an administration charge. Please note cash refunds will not be given.

16. The Management reserves the right to refuse admission in reasonable circumstances including, without limitation, for health and safety, licence restrictions or where a ticket is void.

17. The Management reserves the right to remove any ticket holder from the Theatre, without refund, on reasonable grounds including, without limitation, where the ticket holder breaches these Terms and Conditions, disrupts other audience members' enjoyment or does anything that the Management considers to be unacceptable behaviour or which may cause damage, nuisance or injury. Ticket holders must comply with instructions and directions given by the Theatre staff.

18. Tickets may be restricted to a maximum number per person. Any such restriction will be notified to you upon purchase of the tickets. Tickets purchased in excess of this limit may be cancelled by the Management without prior notice.
19. The unauthorised use of photographic and recording equipment of any kind within the Theatre is strictly forbidden. Unauthorised recordings, tapes, films or similar items may be confiscated and destroyed. Any recording made of an Event in breach of these conditions shall belong to the Promoter and the ticket holder agrees to assign any and all rights in the recording to the Promoter.

20. Ticket holders consent to filming and sound recording as members or the audience. The Promoter may use such films and recordings (including any copies) without payment to ticket holders.

21. Mobile telephones and messaging equipment must be silenced or switched off during the Event

22. The Management is entitled to conduct security searches of persons and property to ensure the safety of all patrons at the Theatre and confiscate any item which in the opinion of the Management may cause danger or disruption to other members of the audience or the Event or is one of the items not permitted in the Theatre as listed in these Terms and Conditions.

23. Ticket holders may only leave and then re-enter the Theatre during a performance as required by the Theatre's health and safety obligations or at the discretion of the Management. Otherwise there shall be no re-admissions or pass-outs of any kind. Every effort to admit latecomers will be made at a suitable break in the Event, but admission cannot always be guaranteed.

24. Parents and/or supervisors are responsible for supervising children in their care at all times and supervision of children shall be by not less than 1 adult per 10 children. The Management reserves the right to ask parents/supervisors to remove children if, in their opinion, they are causing a disturbance.

25. The following are not permitted within the Theatre: smoking (unless within designated smoking areas (if any)); laser pens; animals (except guide dogs); ticket holders' own food and drink; bottles, cans or glass containers; any item which may be interpreted as a potential weapon (including sharp or pointed objects such as knives); and illegal substances. Alcohol may only be consumed in public bars and other authorised areas.

26. The obstruction of gangways, access-ways, exits, entrances or staircases, congregating in non-designated areas or seeking entry to stands or seats for which ticket holders do not hold a Ticket is strictly forbidden.

27. Ticket holders must comply with all relevant statutes, safety announcements and Theatre regulations whilst attending the Event. For health and safety reasons, the Management reserves the right to restrict access to parts of the Theatre. If ticket holders have any special requirements or concerns about any special effects (for example lighting or sound effects) which may be featured at the Event, prior notice should be provided when ordering the tickets.

28. Ticket holders are advised that official merchandise is usually only available inside the Theatre. The Management does not accept any responsibility for the sale of merchandise (official or otherwise) in or outside the Theatre.

29. Ticket holders shall not bring into the Theatre or display or distribute (whether for free or not) at the Event any sponsorship, promotional or marketing materials.

30. Except to the extent that the Management is required or permitted by law, personal information provided by you to the Management will be used for all purposes reasonably connected with the operations of the Theatre including (but not limited to): supplying you with the goods that you request; conducting market research and establishing customer profiles; and transferring or disclosing the information provided to the Management's professional advisors and such other parties as it considers necessary in the administration of its business . The Management will not use or disclose your personal information to any other party or for any other reason other than as set out in these Terms and Conditions without your prior consent. By purchasing a ticket you consent to the use of your personal information in this way. If you have any queries about this, please write to the Management.

31. Unless you inform the Management otherwise, by purchasing a ticket or tickets you authorise the Management to use personal details obtained in the course of the transaction to: provide details of forthcoming events, offers and services; provide updates as to the latest concessions or any changes thereto; and provide information concerning competitions and other promotional activity.

32. The Management shall not be liable for any loss, damage, cost, or expense, except in respect of death or personal injury resulting from any act or omission on the part of the Management.

33. Personal arrangements including travel and accommodation relating to the Event are at ticket holders own risk and in no event shall the Management or Promoter be liable for any loss of enjoyment or wasted expenditure beyond the ticket price and relevant booking fee. In no case shall any liability (other than for death or personal injury) of the Management or the Promoter include any loss or damage which is not reasonably foreseeable.

34. Neither the Management nor the Promoter will be responsible for any loss, theft or damage of ticket holders' personal belongings, other than caused as a result of the negligence or other breach of statutory duty of the Management or the Promoter. Any such liability shall be limited to the reasonable cost of either replacing or repairing such property (subject to fair wear and tear). Please ensure that no bags or other items of personal property are left unattended anywhere in the Theatre.

35. For the purposes of these Terms and Conditions, 'Force Majeure? means any cause beyond Management's control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. The Management will not be liable to you for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.

36. To the fullest extent permissible in law, the Management shall be entitled to assign any of its rights and obligations under these Terms and Conditions.

37. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Terms and Conditions valid or enforceable.

38. Any person, other than the Management or Promoter, not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions.

39. Nothing in these Terms and Conditions and no action taken by you or the Management under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other fiduciary relationship between you and the Management.

40. These Terms and Conditions and constitute the entire agreement between the parties in connection to the subject matter of these Terms and Conditions and supersede any previous terms and conditions, agreement or arrangement between you and the Management relating to the subject matter of these Terms and Conditions. These Terms and Conditions cannot be varied or amended in any respect.

41. These Terms and Conditions shall be governed by the laws of England and Wales and parties agree to submit to the exclusive jurisdiction of the English courts.

Theatre Box Office Terms & Conditions

1. In these Terms and Conditions:

"Event" means an entertainment event including, without limitation, a theatrical event to be held at the Theatre in respect of which the Management has the right to sell you tickets.

"Management" means Live Nation (Venues) UK Limited, its representatives, servants and employees.

"Promoter" means the person or company staging the Event if different from the Management.

"Theatre" means any of the Management's theatrical venues in the United Kingdom.

"you" means you or anybody who in the Management's reasonable opinion is acting with your authority or permission. "your" shall be read accordingly.

2. Incorporation

These Terms and Conditions incorporate and should be read in accordance with the Theatre terms, conditions and regulations, copies of which are available upon request from the Theatre.

3. Tickets

All tickets are sold subject to availability and subject to these Terms and Conditions. Your payment of the Management's invoice in relation to the purchase of tickets constitutes acceptance of these Terms and Conditions.

Only customers holding a valid ticket will be admitted into an Event. Babes in arms (children under 2 years of age) will only be admitted into an Event without a ticket with the specific authorisation of the Management.

Removing any part of, altering or defacing the ticket may invalidate a ticket holders' ticket.

Upon purchase, please check tickets carefully as mistakes cannot always be rectified after purchase. Tickets are not issued on a sale or return basis and refunds will not be made on returned tickets unless provided for under these Terms and Conditions.

The Management will not be responsible for any ticket that is lost, stolen or destroyed. Duplicates may be issued at the Management's discretion. In the event of duplicates being issued, a reasonable administration charge may be levied.

All ticket discounts are subject to limited availability, and the discretion of the Management and/or Promoter. Only one discount per ticket may apply. Proof of identity and concession entitlement (for example of age, employer or student status (if relevant)) may be requested.

The ticket holder only has the right to a seat of a value corresponding to that stated on the ticket and the Promoter and the Management reserve the right to provide alternative seats to those specified on the ticket should the staging of the Event so reasonably require. Where only seats of a lesser value are available, the Management shall compensate affected ticket holders to a maximum of the difference between the cost of the seats.

4. Price and payment

The price of a ticket shall be the price set at the time the Management accepts your order. All prices set are inclusive of any applicable taxes but exclusive of any booking fee and collection fee. No tickets will be released until the Management has received full payment.

5. Changes to the Event

Tickets are sold subject to the Promoter's and the Management's right to alter or vary the published Event programme where reasonably necessary.

6. Cancelled/re-scheduled Events

It is the responsibility of the ticket holder to ascertain whether an Event has been cancelled or re-scheduled and the date and time of any re-scheduled Event. Where an Event is cancelled or re-scheduled, the Management will use its reasonable endeavours to notify you using the details you provided it with at the time of booking. The Management does not guarantee that you will be informed of such cancellation before the date of the Event.

It is your responsibility to inform the Management of any change to the contact address, telephone number or email address you provide it with at the time of ordering.

7. Refunds/exchanges

Tickets cannot be exchanged or refunded after purchase unless the performance is cancelled, rescheduled or where there is a material change to the Event. A ?material' change is a change which, in the Management's reasonable opinion, makes the Event materially different to the Event that purchasers of the ticket, taken generally, could reasonably expect. The use of understudies shall not be a material change.

Where an Event is cancelled, rescheduled or where there is a material change to the programme of the Event, you will be entitled to claim a refund from the Management in accordance with this clause. Where such a refund is sought due to a material change in the Event, you must bring this to the Management's attention as soon as possible upon becoming aware of such change. Where a refund is sought due to the Event being rescheduled you must bring this to the Management's attention prior to the rescheduled Event.

The refund for tickets equals the face value of the tickets purchased plus the relevant per ticket booking fee. In order to claim your refund, please apply in writing to the Management, enclosing your complete unused tickets within 3 months from the date of the Event. The Management will not make any refund if tickets are not received by the Management within 3 months of the date of the Event. Refunds will only be made to the person who purchased the tickets. Please note that in any event, no cash refunds will be given.

8. Void tickets

Tickets are personal revocable licences and shall at all times remain the property of the Management and subject to these Terms and Conditions.

If a ticket is re-sold, transferred or advertised for profit or commercial gain by anyone other than the Management, Promoter, or an authorized sub-agent, it will become voidable and the ticket holder may be refused entry to, or ejected from, the Theatre without refund.

Tickets obtained in breach of these Terms and Conditions shall be null and void and the Management may refuse to admit such ticket holder into the Theatre. Any person seeking to use such a void ticket in order to gain or provide entry to an Event will be considered to be a trespasser and will be ejected and liable to legal action.

Void tickets are non-refundable.

9. Unwanted tickets

Where a performance is sold out, the Management will endeavour to resell any unwanted tickets at the ticket holder's request. Such tickets will be resold at face value and the original ticket purchaser or holder (as appropriate) will be reimbursed the face value of the ticket less an administration charge. Please note cash refunds will not be given.

10. Conditions of admission

The Management reserves the right to refuse admission in reasonable circumstances including, without limitation, for health and safety, licence restrictions or where a ticket is void.

The Management reserves the right to remove any ticket holder from the Theatre, without refund, on reasonable grounds including, without limitation, where the ticket holder breaches these Terms and Conditions, disrupts other audience members' enjoyment or does anything that the Management considers to be unacceptable behaviour which may cause damage, nuisance or injury.

Ticket holders must comply with instructions and directions given by the Theatre staff.

11. Restrictions and prohibitions

Tickets may be restricted to a maximum number per person. Any such restriction will be notified to you upon purchase of the tickets. Tickets purchased in excess of this limit may be cancelled by the Management without prior notice.

The unauthorised use of photographic and recording equipment of any kind within the Theatre is strictly forbidden. Unauthorised recordings, tapes, films or similar items may be confiscated and destroyed. Any recording made of an Event in breach of these conditions shall belong to the Promoter and the ticket holder agrees to assign any and all rights in the recording to the Promoter.

Ticket holders consent to filming and sound recording as members or the audience. The Promoter may use such films and recordings (including any copies) without payment to ticket holders.

Mobile telephones and messaging equipment must be silenced or switched off during the Event.

The Management is entitled to conduct security searches of persons and property to ensure the safety of all patrons at the Theatre and confiscate any item which in the opinion of the Management may cause danger or disruption to other members of the audience or the Event or is one of the items not permitted in the Theatre as listed in these Terms and Conditions.

Ticket holders may only leave and then re-enter the Theatre during a performance as required by the Theatre's health and safety obligations or at the discretion of the Management. Otherwise there shall be no re-admissions or pass-outs of any kind. Every effort to admit latecomers will be made at a suitable break in the Event, but admission cannot always be guaranteed.

Parents and/or supervisors are responsible for supervising children in their care at all times and supervision of children shall be by not less than 1 adult per 10 children. The Management reserves the right to ask parents/supervisors to remove children if, in their opinion, they are causing a disturbance.

The following are not permitted within the Theatre: smoking (unless within designated smoking areas (if any)); laser pens; animals (except guide dogs); ticket holders' own food and drink; bottles, cans or glass containers; any item which may be interpreted as a potential weapon (including sharp or pointed objects such as knives); and illegal substances. Alcohol may only be consumed in public bars and other authorised areas.

The obstruction of gangways, access-ways, exits, entrances or staircases, congregating in non-designated areas or seeking entry to stands or seats for which ticket holders do not hold a Ticket is strictly forbidden.

12. Health and Safety

Ticket holders must comply with all relevant statutes, safety announcements and Theatre regulations whilst attending the Event.

For health and safety reasons, the Management reserves the right to restrict access to parts of the Theatre.

If ticket holders have any special requirements or concerns about any special effects (for example lighting or sound effects) which may be featured at the Event, prior notice should be provided when ordering the tickets.

13. Merchandise

Ticket holders are advised that official merchandise is usually only available inside the Theatre. The Management does not accept any responsibility for the sale of merchandise (official or otherwise) in or outside the Theatre.

Ticket holders shall not bring into the Theatre or display or distribute (whether for free or not) at the Event any sponsorship, promotional or marketing materials.

14. Data protection

Except to the extent that the Management is required or permitted by law, personal information provided by you to the Management will be used for all purposes reasonably connected with the operations of the Theatre including (but not limited to): supplying you with the goods that you request; conducting market research and establishing customer profiles; and transferring or disclosing the information provided to the Management's professional advisors and such other parties as it considers necessary in the administration of its business . The Management will not use or disclose your personal information to any other party or for any other reason other than as set out in these Terms and Conditions without your prior consent. By purchasing a ticket you consent to the use of your personal information in this way. If you have any queries about this, please write to the Management.

Unless you inform the Management otherwise, by purchasing a ticket or tickets you authorise the Management to use personal details obtained in the course of the transaction to: provide details of forthcoming events, offers and services; provide updates as to the latest concessions or any changes thereto; and provide information concerning competitions and other promotional activity.

15. Limitation of Liability

The Management shall not be liable for any loss, damage, cost, or expense, except in respect of death or personal injury resulting from any act or omission on the part of the Management.

Personal arrangements including travel and accommodation relating to the Event are at ticket holders own risk and in no event shall the Management or Promoter be liable for any loss of enjoyment or wasted expenditure beyond the ticket price and relevant booking fee. In no case shall any liability (other than for death or personal injury) of the Management or the Promoter include any loss or damage which is not reasonably foreseeable.

Neither the Management nor the Promoter will be responsible for any loss, theft or damage of ticket holders' personal belongings, other than caused as a result of the negligence or other breach of statutory duty of the Management or the Promoter. Any such liability shall be limited to the reasonable cost of either replacing or repairing such property (subject to fair wear and tear). Please ensure that no bags or other items of personal property are left unattended anywhere in the Theatre.

16. Force majeure

For the purposes of these Terms and Conditions, "Force Majeure" means any cause beyond Our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. The Management will not be liable to you for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.

17. Assignment

To the fullest extent permissible in law, the Management shall be entitled to assign any of its rights and obligations under these Terms and Conditions.

18. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Terms and Conditions valid or enforceable.

19. Third parties

Any person, other than the Management or Promoter, not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions.

20. No partnership or agency

Nothing in these Terms and Conditions and no action taken by you or the Management under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other fiduciary relationship between you and the Management.

21. Entire agreement, amendments and variations

These Terms and Conditions and constitute the entire agreement between the parties in connection to the subject matter of these Terms and Conditions and supersede any previous terms and conditions, agreement or arrangement between you and the Management relating to the subject matter of these Terms and Conditions. These Terms and Conditions cannot be varied or amended in any respect.

22. Governing law and jurisdiction

These Terms and Conditions shall be governed by the laws of England and Wales and parties agree to submit to the exclusive jurisdiction of the English courts.

LiveCard Terms & Conditions

1. In these Terms and Conditions:

"Account Number" means the account number issued to you upon your purchase of a LiveCard.
"Benefits" means the benefits that you may be entitled to when you purchase the LiveCard, as will be notified to you when you receive your LiveCard and/or as may be found on www.LiveCard.co.uk.
"LiveCard" means the card issued by Live Nation in accordance with these Terms and Conditions.
"Event" means a theatrical event at a Live Nation Theatre for which you have chosen to purchase Tickets.
"Initial Fee" means the sum payable by you as set by Live Nation at the date of purchase of your LiveCard in respect of the Initial Period.
"Initial Period" means the 12-month period commencing from the date you are issued with your Account Number in accordance with clause 4.4.
"Live Nation" means Live Nation (Venues) UK Limited (Company no: 1444368) whose registered office is at 35 - 36 Grosvenor Street, London, W1K 4QX.
"Live Nation Theatres" means the theatres listed on www.LiveNationTheatres.co.uk.
"Membership Period" means the period during which your LiveCard is valid in accordance with these Terms & Conditions.
"Annual Fee" means the sum payable by you as set by Live Nation at the end of the Initial Period in respect of the subsequent twelve-month period of membership and at the end of each further twelve-month period.
"Theatre Terms and Conditions" means the terms and conditions applicable to customers purchasing Tickets and attending Live Nation Theatres (as amended from time to time in Live Nation's discretion), a copy of which is available on www.LiveCard.co.uk.
"Tickets" means tickets for the Event.
"You" means the person to whom the Account Number and subsequent LiveCard is issued. "Your" shall be read accordingly.

2. Incorporation

2.1. These Terms and Conditions incorporate and should be read in accordance with the Theatre Terms and Conditions, a copy of which is available on www.LiveCard.co.uk.

3. General

3.1. These Terms and Conditions apply to your use of the LiveCard during the Membership Period. Your purchase of a LiveCard constitutes acceptance of these Terms and Conditions.

3.2. Live Nation agrees to inform you of any material amendment to these Terms & Conditions as soon as is reasonably practicable.

3.3. Tickets are sold subject to availability and to these Terms and Conditions. In the event of any inconsistency between the Theatre Terms & Conditions and these Terms & Conditions, the relevant Theatre Terms & Conditions shall take precedence.

3.4. Words denoting the singular include the plural and vice versa.

4. LiveCard membership applications

4.1. To purchase a LiveCard, you must be at least 18 years of age and be a resident in the UK.

4.2. LiveCards may be obtained by completing one of the LiveCard application forms which you can obtain by any of the following methods:

4.2.1. by contacting the Ticketmaster Hotline on 0870 145 1153 at any time; or

4.2.2. visiting any Live Nation Theatre box office in person between the hours of 10am to 6pm on Monday to Saturday.

4.3. Live Nation, in its sole discretion, reserves the right to refuse any application for the LiveCard.

4.4. Upon acceptance of your application and subject to your payment of the Initial Fee, you will be issued with an Account Number. No Account Number will be released until Live Nation has received full payment of the Initial Fee.

4.5. Within approximately 28 days from receipt of your application, you shall be issued with your LiveCard. If you have not received your LiveCard within 28 days of your application, please contact Live Nation via one of the methods outlined in clause 4.2 or by sending an email to LiveCard@livenation.co.uk.

4.6. The Account Number can be used to book Tickets until you have been issued with your LiveCard.

4.7. Subject to these Terms & Conditions, the LiveCard shall be valid for the Membership Period, commencing on the date that you are issued with your Account Number.

5. LiveCard membership renewal

5.1. At least one month before the expiry of the Initial Period (or any subsequent twelve month period), Live Nation will offer you the opportunity to extend your Membership Period for a further twelve-month period. Any extension of Membership Period shall be subject to the payment of the Annual Fee and these Terms and Conditions.

6. Use of the LiveCard

6.1. Your LiveCard is a personal revocable licence and shall at all times remain the property of Live Nation.

6.2. Live Nation reserves the right to refuse to supply you with a LiveCard under any circumstances and/or demand the return of your LiveCard and/or cancel it at any time if, in its reasonable opinion, you are in breach of these Terms and Conditions.

6.3. Your LiveCard is strictly non-transferable to any third parties. Only you shall be entitled to use your LiveCard and only in accordance with these Terms and Conditions. If the LiveCard is transferred it shall become void and your Membership Period may be cancelled without refund.

6.4. Benefits and Tickets obtained in breach of these Terms and Conditions shall be null and void and Live Nation may refuse to admit such Ticket holder into the Live Nation Theatre. Any person seeking to use such a voided ticket in order to gain or provide entry to an Event will be considered to be a trespasser and will be ejected and liable to legal action.

6.5. LiveCards are only valid during the Membership Period. Damaging, destroying or tampering in any way with your LiveCard may make it void.

6.6. The Initial Fee and, if applicable, the Annual Fee shall be strictly non-refundable in the event that a LiveCard is declared void.

6.7. Live Nation may, in its sole discretion, vary the number and location of the Live Nation Theatres to which the LiveCard will apply.

7. Benefits

7.1. Benefits and/or Tickets for the Event are subject to availability and to these Terms and Conditions.

7.2. A valid LiveCard may entitle you to some or all of the Benefits. You acknowledge that the Benefits may be added to, varied or removed by Live Nation at its sole discretion at any time and without notice to you. Accordingly, a particular Benefit may not be available at the time of your Ticket booking.

7.3. Benefits may only be used in respect of a maximum of four Tickets or as may be otherwise determined by Live Nation. Live Nation may cancel tickets purchased in excess of this limit without prior notice.

7.4. Unless otherwise agreed by Live Nation, you shall not be entitled to use the LiveCard in conjunction with any other benefits, concessions or promotions offered by Live Nation or your chosen Live Nation Theatre.

8. Booking Tickets

8.1. Subject to availability, you may book your Tickets using your LiveCard via the following:

8.1.1. by contacting the Ticketmaster Hotline on 0870 145 1153 at any time

8.1.2. visiting any Live Nation Theatre box office in person between the hours of 10am to 6pm on Monday to Saturday; or

8.1.3. applying online via www.LiveCard.co.uk.

8.2. All telephone calls are charged at rates applicable at the time. You should have your LiveCard with you when you make your booking, as you will need to provide certain details found on the LiveCard.

8.3. If Tickets are purchased via Ticketmaster, you acknowledge that this will constitute a contract between you and Ticketmaster and shall be subject to Ticketmaster's own terms and conditions as applicable at such date.

8.4. If Tickets are purchased via any Live Nation Theatre box office you acknowledge that this will constitute a contract between you and Live Nation and be subject to the Live Nation Theatre Terms and Conditions.

9. Lost or Stolen LiveCards

9.1. You must inform Live Nation as soon as possible if your LiveCard is lost or stolen. You shall not be issued with a new LiveCard. However, at Live Nation's sole discretion, you may be allowed to continue to obtain the Benefits by quoting your LiveCard Account Number.

10. Cancellation of the LiveCard by you

10.1. You shall have the right to cancel your membership to the LiveCard within 7 days of the date of issue of your Account Number in accordance with clause 4.4, without reason. You will not be subject to a cancellation charge and Live Nation shall return your Initial Fee to you within 30 days of such cancellation, either by cheque or by re-crediting your credit/debit card.

10.2. In the event that you wish to cancel your LiveCard in accordance with clause 10.1, you should contact Live Nation by one of the methods set out in clause 4.2.

11. Cancellation by Live Nation

11.1. Live Nation may cancel your LiveCard with immediate effect in the event that:

11.1.1. you provide any false information at the time you purchase the LiveCard or at any time following such purchase; and/or

11.1.2. there is any irregularity in the payment of the Initial Fee or the Annual Fee or
the purchase of any Tickets; and/or

11.1.3. you, in any way, misuse the LiveCard; and/or

11.1.4. you breach these Terms & Conditions and/or any applicable Theatre Terms & Conditions
as determined by Live Nation in its reasonable opinion.

11.2. In the event of cancellation of your LiveCard by Live Nation and without prejudice to Live Nation's existing rights and remedies, you shall not be entitled to a refund of the Initial Fee and/or the Annual Fee (or any part thereof) and shall return your LiveCard to Freepost LiveCard immediately.

11.3. Live Nation shall have the right to refuse any further attempts by you to purchase a LiveCard following any cancellation by Live Nation in accordance with the clause 11.1 above.

11.4. Without prejudice to clause 11.1, Live Nation may cancel your LiveCard at any time with immediate effect on giving you 30 days written notice. In such circumstances, you shall be refunded that part of the Initial Fee or the Annual Fee (as relevant and on a pro rata basis) having regard to the duration of your Membership Period.

12. Data protection

12.1. You must ensure that the information provided by you at the time you purchase your LiveCard is accurate and complete and contains your correct name, contact address, telephone number and/or email address and any other requested details. It is your responsibility to inform Live Nation at the Live Nation Theatre specified by you at the time of applying for membership of your LiveCard of any changes to these details.

12.2. Except to the extent that Live Nation is required or permitted by law, personal information provided by you to Live Nation will be used for all purposes reasonably connected with supply of the LiveCard and/or the operations of the Theatre including (but not limited to): supplying you with the Benefits (including but not limited to issuing you your LiveCard; responding to any enquiry made by you; providing you with details of LiveCard updates, forthcoming events, offers and services; providing you with newsletters as to the latest Benefits or any changes thereto; providing updates as to the latest concessions or any changes thereto and providing information concerning competitions and other promotional activity); conducting market research and establishing customer profiles and transferring or disclosing the information provided to Live Nation's professional advisors and such other parties as it considers necessary in the administration of its business. By purchasing a Ticket you consent to the use of your personal information in this way. Live Nation will not use or disclose your personal information to any other party or for any other reason other than as set out in these Terms and Conditions without your prior consent. If you have any queries about this, please write to Live Nation.

12.3. If you object to Live Nation using your information for the purposes set out in clauses 12.2, please inform Live Nation at the time of purchase of your LiveCard or contact Live Nation on LiveCard@livenation.co.uk at any time.

13. Queries and complaints

13.1. Any queries or complaints in respect of the LiveCard should be made by calling the Ticketmaster Live Card Customer Services hotline 0870145 1153, in writing to Freepost LiveCard or via www.LiveCard.co.uk.

14. Limitation of Liability

14.1. Live Nation shall not be liable for any loss, damage, cost, or expense, except in respect of death or personal injury resulting from the negligence of Live Nation or in respect of fraudulent misrepresentation or any other matter which cannot be excluded by law.

14.2. Under no circumstances shall Live Nation be liable or responsible under these Terms & Conditions in respect of the following:

14.2.1. the permanent or temporary closure of any Live Nation Theatre for whatever reason;

14.2.2. any inability to gain access to the Ticketmaster Hotline and/or the Live Nation Theatre box office;

14.2.3. any inability to access or any downtime or errors in respect of www.LiveNation.co.uk/LiveCard;

14.2.4. any unavailability, delay or non-delivery of Tickets by either the Live Nation Theatre Box Office, Ticketmaster due to any reason beyond Live Nation's reasonable control;

14.2.5. any purchase of Tickets from Ticketmaster in accordance with clause 8.1.1;

14.2.6. subject to any other applicable terms and conditions, any unavailability, cancellation or postponement of any performance at any Live Nation Theatre,

14.2.7. any acts, omissions, occurrences or any failure or interruption in any services provided by Live Nation or any third parties or technical malfunctions that are beyond the reasonable control of Live Nation; and/or

14.2.8. any indirect, economic or consequential losses (including (without limitation) loss of profits) or any other compensation which may arise out of or in connection with the LiveCard or these Terms & Conditions.

14.3. Subject to clause 14.1, to the fullest extent permissible in law, Live Nation's liability to you shall not exceed the Initial Fee or Annual Fee (as relevant).

14.4. You acknowledge that you will be responsible for the payment of Tickets and/or any loss or damage you may cause at any Live Nation Theatre.

15. Force majeure

15.1. For the purposes of these Terms and Conditions, "Force Majeure" means any cause beyond Live Nation's control including, without limitation, avian flu, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. Live Nation will not be liable to you for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.

16. General

16.1. To the fullest extent permissible in law, Live Nation shall be entitled to assign any of its rights and obligations under these Terms and Conditions.

16.2. If any provision of these Terms and Conditions is found to be invalid or unenforceable by any court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Terms and Conditions valid or enforceable.

16.3. Any person not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions.

16.4. Nothing in these Terms and Conditions and no action taken by you or Live Nation under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other fiduciary relationship between you and Live Nation.

16.5. These Terms and Conditions and constitute the entire agreement between the parties in connection to the subject matter of these Terms and Conditions and supersede any previous terms and conditions, agreement or arrangement between you and Live Nation relating to the subject matter of these Terms and Conditions. These Terms and Conditions cannot be varied or amended in any respect.

16.6. These Terms and Conditions shall be governed by the laws of England and Wales and parties agree to submit to the exclusive jurisdiction of the English courts.
